Terms of Service
Last updated: January 2026
These terms govern your use of the HTMLforme website and our services. By using our site or hiring us, you agree to these terms. We've written them in plain language because we believe agreements should be understandable.
Our Services
HTMLforme provides website design, development, and hosting services. The specific scope of any project is defined in our communications with you before work begins. If it's not in writing, it's not in scope.
Your Responsibilities
When you work with us, you agree to:
- Provide content, feedback, and approvals in a timely manner
- Ensure you have the rights to any content you provide (text, images, logos, etc.)
- Pay invoices according to agreed terms
- Not use our services for anything illegal or harmful
Payment Terms
Payment terms are agreed upon before project start. Generally:
- A deposit is required before work begins
- Final payment is due upon project completion, before launch
- Late payments may incur additional fees or pause active work
Specific payment schedules will be outlined in your project agreement.
Revisions
Our projects include a reasonable number of revisions, which we'll define upfront. Revisions beyond the agreed scope may incur additional charges. "Revision" means changes to approved work—if you change direction entirely, that's a new project.
Intellectual Property
Your Content
You retain ownership of all content you provide (text, images, logos, etc.). By providing it, you grant us permission to use it for your project.
Our Work
Upon full payment, you own the final deliverables—your website is yours. However:
- We retain the right to display the work in our portfolio
- We retain ownership of any underlying tools, frameworks, or code libraries we've developed independently
- Third-party assets (fonts, stock photos, plugins) remain subject to their respective licenses
Self-Hosting Clients
If you opt for our self-hosting service, you own the hardware and all the files on it. We configure and maintain it, but it's your property.
Hosting & Maintenance
If we host your site or provide ongoing maintenance:
- We'll make reasonable efforts to keep your site online and secure
- We're not liable for downtime caused by factors outside our control (internet outages, DDoS attacks, acts of nature, etc.)
- We'll notify you of any planned maintenance that might cause downtime
- Either party can end hosting services with 30 days written notice
Limitation of Liability
Here's the part where we protect ourselves (fairly, we hope):
- We're not liable for indirect, incidental, or consequential damages (lost profits, lost data, business interruption, etc.)
- Our total liability for any claim is limited to the amount you paid us for the relevant service
- We don't guarantee that your website will achieve specific business results—we build good websites, but your success depends on many factors beyond our control
Warranties
We warrant that:
- Our work will be performed professionally and competently
- The work we deliver will substantially match what was agreed upon
- To our knowledge, our original work won't infringe on others' intellectual property
Beyond that, our services are provided "as is." We don't make warranties about third-party tools, platforms, or services.
Termination
Either party can end a project:
- By you: You may cancel at any time. You'll owe payment for work completed to date.
- By us: We may end a project if terms are violated, payments are severely overdue, or the working relationship becomes untenable. We'll provide reasonable notice and deliver any completed work.
Dispute Resolution
If we have a disagreement, let's talk it out first—most issues can be resolved with a conversation. If that fails, we agree to attempt mediation before pursuing legal action. Any legal proceedings will be governed by the laws of our jurisdiction.
Affiliate Links
Our website contains affiliate links (currently Amazon Associates). If you purchase through these links, we may earn a commission at no additional cost to you. We only recommend products we genuinely believe are useful.
Changes to These Terms
We may update these terms occasionally. The "last updated" date at the top will change when we do. Continued use of our services after changes constitutes acceptance. For active projects, the terms in effect when the project started will apply.
